These Terms and Conditions ("Terms") govern access to and use of the EazyClaims platform and website at eazyclaims.in (together, the "Service"), operated by EazyClaims, #316, Hennur Main Road, Kalyan Nagar, Bengaluru 560043, Karnataka, India ("EazyClaims", "we", "us"). By using the Service you agree to these Terms.

1. Acceptance of terms

By creating an account, subscribing to the Service, or otherwise using it, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which form part of these Terms. If you do not agree, you must not use the Service.

2. Definitions

"Service" means the EazyClaims software platform, including digital claim record keeping, OCR data extraction and inbox integration, and this website. "Subscriber" means the person or firm that purchases a subscription to the Service. "Claim Data" means documents and information uploaded to or processed by the Service in connection with a motor insurance claim, including estimates, bills, policy documents, photographs and additional documents, whether uploaded by the Subscriber, a customer or a garage owner. "Users" means the Subscriber and any person the Subscriber permits to use the Service.

3. Description of the Service

EazyClaims is documentation software for motor vehicle insurance surveyors. It provides: (a) digital record keeping for surveys and claims, including document upload by customers and garage owners; (b) built-in optical character recognition ("OCR") that extracts data from uploaded documents and pre-fills forms, using traditional, deterministic OCR technology and not artificial intelligence; and (c) inbox integration that, with the Subscriber's authorization, detects incoming emails indicating a new survey assignment or an issued payout. The Service assists with documentation; it does not perform surveys, assess losses or provide insurance, legal or professional advice, and Subscribers remain solely responsible for the content and accuracy of their reports and professional work.

4. Eligibility and accounts

The Service is intended for use by professionals and businesses, including licensed insurance surveyors and loss assessors. You must be at least 18 years of age and capable of entering into a binding contract under Indian law. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and you agree to notify us promptly of any unauthorised use.

5. Subscription term and fees

The Service is offered on a yearly subscription at ₹10,000 (Indian Rupees ten thousand) per year, plus applicable taxes. Fees may be revised for future terms with notice before renewal; a revision never affects a term already paid for. Subscriptions do not renew automatically — access ends at the close of the paid term unless renewed by you.

6. Payments and refunds

Fees are payable in advance for the full subscription term. All payments are final. No refunds, cancellations, credits or pro-rata returns are provided after payment, for any reason, including unused time, as set out in our Refund Policy, which you accept by making payment.

7. Subscriber data and documents

As between the parties, the Subscriber owns all Claim Data. You grant EazyClaims a limited, non-exclusive licence to host, store, process (including by OCR) and display Claim Data solely to provide and support the Service. You are responsible for ensuring you have the right and any consents necessary to upload Claim Data — including documents received from customers, garage owners and insurers — and that your use of the Service complies with your obligations to those parties. We will handle personal data within Claim Data in accordance with our Privacy Policy and applicable law.

8. Third-party services and inbox authorization

Inbox integration operates on email accounts (such as Gmail) under an authorization you grant and may revoke at any time through your account or your email provider's settings. The scope of access is limited to what is needed to detect survey assignments and payout notices. Your use of third-party services remains subject to those providers' own terms, and we are not responsible for their availability or acts.

9. Acceptable use

You must not: (a) use the Service for any unlawful purpose, including the fabrication or falsification of claims or documents; (b) upload content that is malicious, infringing or that you have no right to upload; (c) attempt to gain unauthorised access to the Service or its systems, or probe, scan or test their vulnerability without written authorization; (d) resell, sublicense or provide the Service to third parties except to Users within your own practice; or (e) interfere with the integrity or performance of the Service. We may suspend or terminate access for material breach of this section.

10. Intellectual property

The Service, including its software, design, text and trademarks (including "EazyClaims"), is and remains the property of EazyClaims and its licensors. Except for the limited right to use the Service during a paid term, no rights are transferred to you. You may not copy, modify, reverse engineer or create derivative works of the Service except to the extent permitted by law that cannot be contractually excluded.

11. Availability, support and maintenance

We work to keep the Service available and dependable, but it is provided on an "as is" and "as available" basis, and uninterrupted or error-free operation is not guaranteed. We may perform maintenance, updates and improvements, and will make reasonable efforts to schedule planned maintenance considerately. Support is available by phone and email, Monday to Saturday, 9:30–18:30 IST.

12. Limitation of liability

To the maximum extent permitted by law: (a) EazyClaims shall not be liable for any indirect, incidental, special or consequential loss, loss of profits, loss of business or loss of data; and (b) the aggregate liability of EazyClaims arising out of or in connection with the Service, whether in contract, tort or otherwise, shall not exceed the subscription fees paid by the Subscriber for the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnity

You agree to indemnify and hold harmless EazyClaims from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your Claim Data, or your use of the Service in violation of law or of the rights of a third party.

14. Suspension and termination

We may suspend or terminate access for material breach of these Terms, unlawful use, or non-payment. You may stop using the Service at any time; fees already paid are not refundable. Upon termination or expiry, you may request an export of your Claim Data within 30 days, after which we may delete it in accordance with our retention practices described in the Privacy Policy.

15. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, subject to any mandatory provisions of applicable law.

16. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version, and material changes will be notified to Subscribers by email or within the Service. Continued use after a change takes effect constitutes acceptance of the revised Terms.
